Bill to Legalize Psychedelics Possession in California Paused

A measure to legalize the possession of psychedelics such as ayahuasca and psilocybin in the state of California will not be advancing this session. The temporary halt to the bill occured after its sponsor decided that more time was needed to compile additional evidence for reform in order to solidify the bill’s chances of being passed. The bill, which had already been cleared in the Senate, will be made into a two-year legislation, which means it will not be advanced to the floor until 2022.

The legislation was sponsored by Sen. Scott Wiener, who has spent a lot of time garnering support for reform, including holding a rally with health officials, law enforcement and military veterans recently. In a press release, Wiener revealed that while he was disappointed the bill wouldn’t be enacted in 2021, more time would allow supporters to refine the bill even further.

He then stated that the government was committed to decriminalizing psychedelics, which would also help end the failed drug war. Wiener added that psychedelics had shown great potential in treating mental health conditions such as depression, anxiety and post-traumatic stress disorder, which would help with the mental health crisis that is getting worse day by day.

The bill, SB519, would remove criminal penalties for the possession of psychedelics, including MDMA, LSD, DMT, ibogaine and psilocybin mushrooms, for individuals aged 21 and above. The bill also includes limits to the amount of each substance a person is allowed to possess. The prescribed limits are listed below:

  • four grams of MDMA
  • four ounces of a fungi or plant that contains psilocin or two grams of psilocin
  • four ounces of a fungi or plant that contains psilocybin or two grams of psilocybin
  • four grams of mescaline
  • 01 grams of LSD
  • 15 grams of ibogaine
  • two grams of DMT

Under the initiative, the state’s Department of Public Health will be required to establish a group to conduct research on and make recommendations regarding possible regulatory systems that the state of California could use to promote equitable and safe access to the substances in permitted legal contexts. The bill also repeals provisions in the state’s statute that prohibit the transportation or growing of any mycelium or spores that contain psilocybin.

Other cities in the country are also working towards decriminalization, with activists in Grand Rapids, Michigan, and Easthampton, Massachusetts, having recently advanced psychedelic reform measures. Santa Cruz and Oakland — both cities in California — have already enacted psychedelics decriminalization.
