California Activists Receive Approval to Gather Signatures for Psilocybin Legalization Measure

Activists in the state of California have received approval to start gathering signatures for a measure to legalize magic mushrooms. Last week, the office of the attorney general released a title and summary for the initiative, which activists are hoping to include in next year’s ballot.

The group behind the proposal, Decriminalize California, is now focused on collecting 623,212 signatures that will allow the initiative, which would legalize the sale of psilocybin under California state law to make the ballot. Advocates are required to gather registered voter signatures in the next 180 days in order to qualify the measure for the ballot.

The official summary issued by the attorney general states that the measure would decriminalize the retail sale, growing, manufacture, distribution, possession, consumption and storage of psilocybin mushrooms and the chemical compounds they contain, as well as the extracts obtained from the mushrooms, for people aged 21 and above.

In an interview, Decriminalize California chapter campaign director Ryan Munevar stated that the organization would be employing a multifaceted approach to ensure that the gathering of signatures happened. Presently, the group has an estimated 2,800 individuals who have volunteered to aid in the process of collecting signatures.

The volunteers will call for support at events such as farmers’ markets in the state. Individuals who would like to be circulators can complete forms online as well as sign the petition. Stores can also register to be signature collection channels and receive petitions.

The initiative’s success would make the state of California the first in the country to widely legalize psilocybin mushrooms for recreational and medical purposes. In November 2020, voters in the state of Oregon approved a measure to legalize psilocybin for therapeutic use.

A recently conducted analysis of the initiative found that it could help generate local tax and state revenue as well as save California lots in enforcement costs. However, officials also note that establishing a regulatory scheme for the substance’s legal market could cost millions, adding that the cost would eventually be fully or partially offset by revenues.

The approval of the petition, which was filed earlier in July, would get rid of limits on personal possession. In addition to this, the measure would also ensure that psilocybin sold for spiritual, religious, therapeutic or medical purposes wouldn’t be subject to any excise or sales tax. However, the local sales tax rate at the point of sale would be imposed on psilocybin products marketed as dietary supplements.
