Massachusetts Legislators File 12 Bills Related to Psychedelics for Consideration

Last week, legislators in the state of Massachusetts filed twelve measures related to psychedelics before the filing deadline lapsed. This comes after Question 4, which would’ve decriminalized the use and possession of DMT, ibogaine, psilocybin, psilocin and mescaline and legalized therapeutic access to psychedelics for individuals aged 21 and above, was defeated at the ballot despite support from the general public.

Let’s look at some of these latest measures below.

Senator Cindy Friedman filed SD 1624, an act that would authorize a pilot for the use of psychedelics in licensed facilities. Under the measure, the Department of Public Health would create a program to monitor the mental health care of patients on psychedelics.

Rep. Marjorie Decker also filed HD 4196 to establish a program enabling access to regulated psilocybin. Under the initiative, the public health department would develop a pilot program enabling the research and development of psilocybin services for individuals with depression, post-traumatic stress disorder, end-of-life distress, or other conditions.

Rep. Lindsay Sabadosa also filed a resolution that would create a pilot program with non-profit therapeutic centers providing psilocybin treatment for physical and mental health needs, with five locations in the Metro Boston area, the South Shore area, the North Shore area, central Massachusetts, and western Massachusetts.

Other initiatives include HD 3020, filed by Rep. Mike Connolly, which focuses on relative harm reduction and racial justice. Connolly also filed HD 4243, a measure that would establish a psychedelics task force.

In addition to this, Rep. Patrick Joseph Kearney filed HD 1003, a measure that would legalize the use of psilocybin. SD 323, a resolution filed by Senator Dylan Fernandez, would focus on enabling veterans to access breakthrough therapies.

Other measures introduced include HD 3895, SD 870, HD 188, and HD 3368, which all focus on the decriminalization of these psychedelic substances.

These moves by legislators reflect increasing public support for decreasing penalties for the personal use of psychedelics.

SD 1408, a separate resolution filed a Sen. Patrick O’Connor, would focus on carrying out a public health study of synthetic drugs. The proposed measure would also offer the public health department with funding to come up with recommendations to decrease the use of synthetic drugs through rehabilitative therapies, educational curriculum, and public awareness campaigns.

In its summary, the proposed resolution stipulates that the term ‘synthetic drug’ would include synthetic opioids, synthetic cocaine, synthetic psychedelics, synthetic marijuana, MDMA, carfentanil, fentanyl, and bath salts.
