New Hawaii Senate Bill May See Psilocybin Mushroom Therapy Legalized

Hawaii may soon be the next state to legalize the use of psilocybin mushrooms if a bill, known as SB 738, that was recently filed in the state legislature is approved.

According to SB 738, the state’s Department of Health would be directed to set up designated centers of treatment, where psilocin and psilocybin will be administered therapeutically. The two psychoactive compounds are produced by fungi from the genus Psilocybe.

The measure’s approval would also lead to the creation of a seven-person panel for psilocybin review that would evaluate the influence of the change in policy, while also facilitating the removal of the two psychoactive substances from Hawaii’s Schedule 1 list of controlled substances. In addition to this, the bill doesn’t cite how the drugs would be administered or who would be legible for therapy.

The measure comes less than a year after legislators in the state introduced legislation to start studying the therapeutic use of psilocybin mushrooms, with the ultimate objective being to legalize them eventually. Sadly, none of the bills advanced.

Despite the ongoing research, entheogenic plants such as ibogaine and ayahuasca have surfaced as promising treatments for various conditions, such as anxiety and severe depression.

The new measure in Hawaii was introduced to the senate by Senators Maile Shimabukuro, Les Ihara Jr., Laura Clint Acasio and Stanley Chang, who are all Democrats. According to the website of the Hawaii state legislature, the bill is yet to be scheduled for a hearing.

Hawaii’s proposal is just one among many other reform bills that have been introduced across the United States in 2021, as drug policy debate transcends that of cannabis alone.

During the elections held in November 2020, Oregonians passed a ballot measure legalizing psilocybin therapy. The state of Oregon is in the process of executing the measure’s statutes. Oregon voters also approved a measure to decriminalize the possession of all psychedelic drugs while voters from Washington DC enacted a bill to decriminalize psychedelics possession.

Earlier this month, a measure was introduced in the state of New York that would do away with criminal penalties for the possession of small amounts of controlled substances. It is expected that similar measures will be introduced this year in both Washington State and California. In addition to this, a Florida legislator revealed plans to introduce a bill to legalize the therapeutic use of psilocybin in that state.

Besides this, a new advocacy group is calling for Congress to apportion $100 million to be used to support research on the therapeutic potential of psychedelics.
